Stephen Ronan is a partner in Lerners' Toronto office and member of its Specialty Risk and Insurance, Defence Class Actions, Appeals, Health Law, and Professional Regulation groups. In Stephen’s specialty risk and insurance practice, he represents insurers and insureds in matters involving personal injury and property damage. He also provides comprehensive coverage advice to insurers on issues arising from various policy types, including title insurance, CGL, and “all-risks” builder’s risk coverage. He has represented insurers in actions and applications for declarations of coverage.

Stephen has particular expertise in aviation matters, with experience litigating claims involving injuries and fatalities. He has defended numerous class actions involving aviation events, in several jurisdictions across Canada. He has advised clients regarding actions commenced in the United States. Stephen also provides coverage opinions and advances subrogated claims on behalf of insurers in claims regarding property damage to aircraft.

Stephen also has considerable experience representing municipalities and public entities in claims related to road maintenance and design, occupiers’ liability, building inspection, fire response and loss and Charter breaches.

In his health law and professional regulation practice, Stephen defends regulated health professionals in negligence claims and in matters before their professional regulators. Stephen has appeared before various discipline tribunals and the Health Professions Appeal and Review Board. Stephen also acts as independent legal counsel to the discipline and fitness to practice committees of various health regulators in Ontario. He has experience advising on complex matters involving allegations of sexual abuse and fraud.

Lumaj v. St. Michael's Hospital, 2023 ONCA 651 - Successfully resisted a motion to set aside an order of the Court of Appeal dismissing a motion for an extension of time to seek leave to appeal a decision of the Divisional Court

  • Salamaszynski v Michael Garron Hospital, 2023 ONSC 704 - Successfully responded to a motion for production of a instructing letter to an expert

  • College of Physicians and Surgeons of Ontario v. Steinberg, 2023 ONPSDT - Represented a physician before the Ontario Physicians and Surgeons Discipline Tribunal regarding allegations of boundary violations.

  • Canada (Transportation Safety Board) v. Carroll-Byrne, 2022 SCC 48 - Represented a moving party on a motion for production of a cockpit voice recorder in connection with a class action. The motion for production was granted and upheld by the Nova Scotia Court of Appeal and Supreme Court of Canada.

  • Levy v. Rubenstein, 2022 ONSC 4547 - Represented defendant radiologists in an action regarding a delayed diagnosis of lung cancer. Action dismissed against one physician on the basis of causation.

  • Vandenakker v. Yen, 2021 (Oral reasons) - Successful motion for summary judgment in a medical negligence action on basis that claim was statute barred and an abuse of process as facts were same as a action that had been previously commenced.

  • Clarke v. Rouge Valley Health System, 2019 ONSC 3082 - Successfully moved for summary judgment of a medical negligence action on the basis that it was commenced outside of the limitation period.

  • Lavelle v. Hospital for Sick Children, 2019 ONSC 5855 - Represented a number of physicians in a motion to add them to an action on the basis of misnomer. Motion dismissed against two physicians.

  • G&P Procleaners and General Contractors Inc. v. Gore Mutual Insurance Company, 2017 ONCA 298 - Responded to an appeal regarding the dismissal of an action on a summary judgment motion on the basis that there was no coverage under a CGL policy.

  • J. K. v. Ontario, 2017 ONCA 902 - Represented third party detention centres in a class action regarding the use of solitary confinement. Third party actions dismissed based on direction from Court of Appeal on amendments to Statement of Claim.

  • Loy-English v. Ottawa Hospital, 2017 ONSC 6533 - Successfully resisted a motion by a lawyer to intervene in a companion medical negligence action.

  • Goldman v. Weinberg, 2017 ONSC 3259 - Successful summary judgment motion regarding a claim by the boyfriend of a parent regarding a report by a physician to the CAS and the

    disclosure of medical records. The Court held that no duty of care was owed and the claim was barred pursuant to s. 71 of PHIPA.

  • Liu v. Wong, 2016 ONCA 366 - Successfully responded to an appeal of a decision on a summary judgment motion to dismiss an action on the basis that the claim was statute barred by the Limitations Act and the plaintiff failed to deliver an expert report on liability.

  • A.W. v. M.S., 2016 CanLII 8838 (ON HPARB) - Represented a respondent physician regarding a request for review of a decision of the Inquiries, Complaints and Reports Committee of the CPSO that a complaint was frivolous and vexatious pursuant to s. 26(5) of the Health Professions Procedural Code.

  • Rippon v. Halton District School Board, 2015 HRTO 1295 - Successfully moved for dismissal of a HRTO application on a summary hearing on the basis that there was no reasonable prospect of success
