In a recent HR Reporter article, Lerners Partner and Employment Lawyer Joshua Lerner shared insights on the risks of worker misclassification and why employers should take a proactive approach to assessing employment relationships. 

Drawing on his experience advising employers and employees, Joshua explained that simply labeling a worker as an independent contractor does not automatically determine their legal status. Instead, courts and tribunals examine the true nature of the relationship, including factors such as control, financial dependence, integration into the business, and the opportunity for profit or risk of loss. 

He also highlighted the significant consequences that can arise when workers are misclassified, including termination obligations, Employment Standards Act liabilities, tax implications, and other retroactive costs. 

“Being proactive pays dividends,” Joshua noted, emphasizing that addressing classification issues before a dispute arises is almost always less costly than dealing with them after the fact.
