Noteworthy Cases

Bankruptcy and Insolvency

  • Fisgard Capital II Corp. v. Montgomery, 2022 ONSC 978: Argued for a corporate lending client that where there are uncontested facts, mortgage enforcement can proceed via application as opposed to an action, to which the court agreed.

  • RBC v. HI & DQ’s Foods Inc., 2025 ONSC 2774: Obtained summary judgment for a banking client against a personal guarantor of a corporate loan, despite the guarantor arguing against any personal liability.

Commercial Litigation & Professional Regulation

  • 1000029174 Ontario Inc. v. Miculinic Investment Corp., 2024 ONCA 526: Represented the successful party on an appeal in a matter dealing with the sale of a property and the correct HST payable on that sale.

  • Matthew R. Harris Professional Corporation v. Carey, 2020 ONSC 7808: Successfully argued that a solicitor cannot proceed with a claim for unpaid legal fees in the face of a previously commenced fee assessment by the client.

  • Fehr v. Gribilas, 2023 ONCA 791: Argued for the respondent in an appeal that affirmed the previous decision (Fehr v. Gribilas, 2022 ONSC 275) wherein the court held that a claim against client accountant was barred due to the operation of a no-claims over clause.

  • OZ Optics Ltd. v. Evans, 2023 ONCA 677: Successfully defended a lawyer in an action commenced by their previous employer. The Court of Appeal affirmed a previous decision (OZ Optics Ltd. v. Evans, 2022 ONSC 5890) granting summary judgment that dismissed the plaintiffs’ claim against our client for having no tangible cause of action.

  • Zenish Polyfilm LLP v. Alpha Marathon Film Extrusion Technologies Inc., 2023 ONSC 1936: Represented a corporate plaintiff in a contractual dispute wherein the court granted judgment to our client for breach of contract related to non-delivery of machinery.
