Compelled Production From Third Parties of Health Records in Sexual Abuse Cases: Legal Principles and Procedures and Guidelines for Health Care Providers

This article, published in the Journal of Women's Health and Law, discusses the different legal tests and procedures employed in criminal and civil proceedings to determine whether access to confidential health records of victims of alleged sexual abuse which are in the hands of third parties will be granted to the defence and, if so, what conditions may be attached to minimize the infringement on victims' rights.
