Lerners LLP successfully represented the City of Hamilton in a landmark appeal upholding the City’s refusal to approve a proposed transit advertisement due to concerns it could cause serious psychological harm or heighten the risk of violence for transgender and gender‑diverse riders. The ruling affirms a 2024 Divisional Court decision—also won by Lerners—that dismissed the related judicial review. The Court held that while freedom of expression is vital, municipalities may reasonably restrict advertising on public property to protect safety and inclusion. The decision now stands as a leading authority on applying the Doré/Loyola framework to advertising on municipal property.

Rivard v. Ontario, 2025 ONCA 100
Lerners represented the appellant chief of police and police services board on an appeal, with leave, from a decision declining to strike allegations of systemic wrongdoing. The claim against the police services board was struck out, and the decision clarified the pleading requirements for such claims.

Gordon Dunk Farms Limited v. HFH Inc., 2021 ONCA 681
Successfully defended claim against an insured contractor relating to an alleged negligent design of a hog-finishing barn, having the case dismissed on a summary judgment motion as statute-barred by the limitation and upholding that dismissal on appeal.
Krieser v. Garber, 2020 ONCA 699
Representing the insured contractor in a trespass claim involving a deck, successfully appealed a punitive damages and substantial costs award against the contractor, having the punitive damages, set aside and costs award significantly reduced.

Represented State Farm at trial and on appeal in complex litigation involving numerous at fault defendants, contributory negligence, and underinsured claims arising out of an impaired driving fatality and severe injury.
