Andersen v. St. Jude Medical, Inc. - a certified national medical device class action representing class members and provincial health ministries. On January 21, 2000, St. Jude Medical Inc. announced a world wide recall of their Silzone coated mechanical heart valves and annuloplasty rings. The Silzone coating, a silver based coating applied to the exterior of the mechanical heart valves and annuloplasty rings, was meant to reduce the risk of bacterial infection.
Approximately 36,000 Silzone coated mechanical heart valves were sold and implanted in patients world wide prior to the world-wide recall. On January 16, 2004, the action was certified as a national class action, with the exception of British Columbia and Quebec. An unprecedented, or subsequently attained, costs award in the amount of $610,700.85, was awarded following certification.

This class action proceeded to trial on an amended form of the common issues in 2010. (Amended Common Issues) (Certification Order) (Order Adding Waiver of Tort) (Order Bifurcating Punitive Damages)
The trial started in February 2010 and closing arguments were finished near the end of September 2011. The judge that heard the trial has reserved and we are awaiting her decision. Once a decision is rendered, notice will again be sent to the Class at the Court's direction.
